The U.S. Supreme Court has granted South Dakota’s certiorari petition in South Dakota v. Wayfair, Inc. et al., and has scheduled oral arguments for April 17. The Wayfair case involves the constitutionality of South Dakota’s economic nexus statute that requires out-of-state, online retailers lacking a physical presence in the state to collect and remit sales tax on their sales delivered to South Dakota customers. Now, Illinois proposes to enter the fray.
